Personalise My Card Terms and Conditions

  1. The Personalise My Card Service ("Service") allows you to put an image of your choice on your ASB Visa Debit Card ("Card").
  2. In addition to these Terms and Conditions, the Service is subject to the Visa Debit Card Conditions of Use.
  3. You agree that any image you submit will comply with the Image Guidelines.
  4. We may, in our sole discretion, refuse to accept or use any image you submit.
  5. You grant us, or will obtain for us from the owner of an image, an irrevocable, non-transferable, non-exclusive, royalty-free licence to use the image for the purpose of providing your Card to you.
  6. You agree to us storing, modifying, copying and using the image.
  7. Cards belong to us and must be returned immediately if we ask you to do so.
  8. All intellectual property rights in the Service (excluding the image) belong to us. You must not reproduce any of our intellectual property without our consent.
  9. We will debit your default account (nominated by you when you apply for your Card), with a fee for each image you choose to use on a Card. If you choose to use the same image when this Card is replaced we will not charge you the fee again. We will charge our normal replacement Card fee. These fees are subject to change and details are provided at www.asb.co.nz.
  10. You warrant that:
    • you own the image or you have express consent from the owner of the image to use the image on your Card (and can provide evidence of such consent);
    • use of the image by ASB will not infringe any third party intellectual property rights; and
    • to the best of your knowledge the image does not contain any viruses.
  11. You agree to indemnify ASB against any claims arising or loss suffered by ASB as a result of our use, modification or storage of the image.
  12. To the extent permitted by law, we will not be liable to you for any direct or indirect costs, losses, damages or other liabilities resulting from your use of the Service.
  13. We may vary these Terms and Conditions at any time. When informing you of a variation, we will give at least 14 days notice of such variation and communicate such changes, either by direct communication, by display in all our branches or by notice in the media (including public notices). Changes to these Terms and Conditions will also be noted on our website.
  14. We may at any time add to, modify or withdraw the Service.
  15. All personal information collected by ASB is for the purpose of providing the Service. The intended recipients of the information are ASB, it subsidiaries, agents and other third parties (whether in New Zealand or overseas) that provide services to ASB. This information will be held by ASB, ASB Bank Centre, 135 Albert Street, Auckland and you have rights of access to and correction of it.
